ProFlyCenter GmbH (hereinafter: PFC) undertakes to take the greatest possible precautions to protect your personal data. As a rule, it is possible to use our pages without providing your personal data. Occasionally, however, we need some data from you in order to be able to provide the information you have requested. The following information describes how PFC stores and uses your data. Therefore, please read the information on data security carefully. By using the PFC internet pages, you consent to the use of your data in accordance with this statement.

1. General

This privacy policy is intended to inform you about the processing of data by PFC.

The processing of personal data, such as the name, e-mail address, or telephone number of a data subject shall always be in line with the EU Data Protection Regulation (hereinafter: GDPR), and in accordance with the country-specific data protection regulations applicable to the PFC. By means of this data protection declaration, our enterprise would like to inform the public about the type, scope and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed of their rights by means of this data protection declaration.

As the controller, the PFC has implemented numerous technical and organisational measures to ensure the most complete protection of personal data processed through this website. Nevertheless, Internet-based data transmissions can always be subject to security vulnerabilities, so that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.

2. Definitions

The data protection declaration of PFC is based on the terminology specified by the DSGVO. Our data protection declaration should be easy to read and understand for both the public and our customers. In order to ensure this, we would like to explain in advance central and important terms used in this data protection declaration.

  • "Personal data" (cf. Art. 4 No. 1 DSGVO)

The term "personal data" means any information relating to an identified or identifiable natural person (hereinafter: "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  • "Processing" (cf. Art. 4 No. 2 GDPR)

The term "processing" shall mean any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

  • "Restriction of processing" (cf. Art. 4 No. 3 GDPR)

The term "restriction of processing" means the marking of stored personal data with the aim of limiting their future processing.

  • "Profiling" (cf. Art. 4 No. 4 DSGVO)

The term "profiling" means any automated processing of personal data which consists in using such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or change of location.

  • "Pseudonymisation" (cf. Art. 4 No. 5 GDPR)

Pseudonymisation" means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures which ensure that the personal data are not attributed to an identified or identifiable natural person.

  • "Responsible person" (cf. Art. 4 No. 7 DSGVO)

A 'controller' is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.

  • "Processor" (cf. Art. 4 No. 8 GDPR)

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the Controller.

  • "Recipient" (cf. Art. 4 No. 9 DSGVO)

"'recipient' means a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigative task under Union or Member State law shall not be considered as recipients.

  • "Third party" (cf. Art. 4 No. 10 GDPR)

"Third party" means any natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons authorised to process the personal data under the direct responsibility of the controller or the processor.

  • "Consent" (cf. Art. 4 No. 11 GDPR)

The term 'consent' means any freely given specific and informed indication of his or her wishes, in the form of a statement or other unambiguous affirmative act, by which the data subject signifies his or her agreement to personal data relating to him or her being processed.

3. Collection and storage of personal data as well as type and purpose of their use

We implement physical, technical and administrative security measures to adequately protect your personal data from loss, misuse, unauthorised access, disclosure and alteration. These security measures include firewalls, data encryption, physical access restrictions to our data centres and permission controls for access to data.

Occasionally we also use information about you from other sources and add this to our information. This includes in particular information from public directories (e.g. commercial register).

a) When visiting the website

When you visit our website https://www.proflycenter.de, or in the future, information is automatically sent to the server of our website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which the access is made (referrer URL),
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The above data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • Evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f) DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations on this under point 7 ff. of this data protection declaration.

b) For access with a mobile terminal

Most mobile devices allow their users to switch off location-based services. In most cases, this option can be found in the menu under "Settings". Click here for information about specific devices. If you have any further questions about how to turn off location-based services on your device, we recommend that you contact your mobile operator or the manufacturer of your device

c) When using our contact form

For questions of any kind, we offer you the possibility to contact us via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address so that we know who the enquiry is from and so that we can answer it. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 p. 1 lit. a) DSGVO on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after completion of your request.

d) Registration for our newsletter

On the PFC website, users are given the opportunity to subscribe to a newsletter. The personal data transmitted to PFC when subscribing to the newsletter is specified in the input mask used for this purpose.

The PFC informs its customers and business partners at regular intervals by means of a newsletter about enterprise offers. The newsletter of our company can basically only be received by the data subject if

  • the data subject has a valid e-mail address and
  • the data subject has registered to receive the newsletter.

When registering for the newsletter, we also store the IP address of the computer system used by the data subject at the time of registration as well as the date and time of registration, which is assigned by the Internet service provider (ISP). The collection of this data is necessary in order to be able to trace a (possible) misuse of the e-mail address of a data subject at a later point in time and therefore serves as a legal safeguard for the controller.

The personal data collected in the context of a registration for the newsletter is used exclusively for sending our newsletter. Furthermore, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or a related registration, as could be the case in the event of changes to the newsletter offer or changes in the technical circumstances. The subscription to our newsletter can be cancelled by the data subject at any time. The consent to the storage of personal data, which the data subject has given us for the newsletter mailing, can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in each newsletter. Furthermore, it is also possible to unsubscribe from the newsletter mailing directly on the website of the controller at any time or to inform the controller of this in another way (e.g. by e-mail or telephone).

If you have expressly consented in accordance with Art. 6 para. 1 p. 1 lit. a) DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an e-mail address.

You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you are welcome to send your unsubscribe request at any time by e-mail to info@proflycenter.com or notify us by telephone.

4. Registration

The data subject has the possibility to register for "my account" on the https://www.proflycenter.de website. The personal data that is transmitted to the data controller in this context results from the respective input mask used for the registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for the data to be transferred to one or more processors, for example a parcel service provider, who will also use the personal data exclusively for an internal use attributable to the controller.

By registering on the website of the controller, the IP address assigned by the Internet service provider (ISP) of the data subject, the date and the time of registration are also stored. The storage of this data takes place against the background that only in this way can the misuse of our services be prevented and, if necessary, this data makes it possible to clarify criminal offences that have been committed. In this respect, the storage of this data is necessary for the protection of the data controller. As a matter of principle, this data is not passed on to third parties unless there is a legal obligation to pass it on or the passing on serves the purpose of criminal prosecution.

The registration of the data subject by voluntarily providing personal data serves the purpose of the controller to offer the data subject content or services which, due to the nature of the matter, can only be offered to registered users. Registered persons are free to modify the personal data provided during registration at any time or to have it completely deleted from the data of the controller.

The controller shall provide any data subject at any time, upon request, with information on what personal data is stored about the data subject. Furthermore, the data controller shall correct or delete personal data at the request or indication of the data subject, provided that this does not conflict with any statutory retention obligations. The data protection officer of PFC and the entire staff of the controller are available as contact persons for the data subject in this context.

5. Passing on data

Your personal data will not be transferred to third parties for purposes other than those listed below.

We will only share your personal information with third parties if:

  • you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a) DSGVO,
  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f) DSGVO for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that a legal obligation exists for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c) DSGVO, as well as
  • this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b) DSGVO for the processing of contractual relationships with you.
  • 6. Data subjects' rights

Every data subject has the right,

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • demand the correction of incorrect or incomplete personal data stored by us without delay in accordance with Art. 16 DSGVO;
  • pursuant to Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  • revoke your consent at any time in accordance with Art. 7 (3) DSGVO. This has the consequence that we may no longer continue the data processing based on this consent for the future, and
  • complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.
  • 7. Right of objection

Insofar as your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) p. 1 lit. f) DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

8. Use of cookies

The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter his or her access data each time he or she visits the website, because this is done by the website and the cookie stored on the user's computer system.

The data subject can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. 9. Privacy policy on the use and application of Facebook

The controller has integrated components of the company Facebook on this website. Facebook is a social network.

A social network can serve as a platform for exchanging opinions and experiences or enables the internet community to provide personal or company-related information. Each time one of the individual pages of this website operated by the data controller is called up and on which a Facebook component (Facebook plug-in) has been integrated, the internet browser on the information technology system of the data subject is automatically caused by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be found at https://developers.facebook.com/docs/plugins/?locale=de_DE. Within the scope of this technical procedure, Facebook receives information about which specific sub-page of our website is visited by the data subject.
